利用規約

この利用規約（以下、「本規約」といいます。）は、当方が提供するホームページ、Webアプリケーションおよびスマートフォン向けアプリケーション（以下、総称して「本サービス」といいます。）の利用条件を定めるものです。

本サービスをご利用になる前に、本規約をよくお読みいただき、同意の上でご利用ください。

第1条（適用）

本規約は、ユーザーと当方との間の本サービスの利用に関する一切の関係に適用されます。
当方は、本サービスに関し、本規約のほか、ガイドライン、ルールその他の個別の定め（以下、「個別規定」といいます。）を設けることがあります。
個別規定は、本規約の一部を構成するものとし、本規約と個別規定の内容が異なる場合は、個別規定が優先して適用されます。

第2条（利用登録）

本サービスの一部では、ユーザー登録が必要となる場合があります。
登録希望者は、当方の定める方法により登録申請を行い、当方がこれを承認した時点で利用契約が成立するものとします。
ユーザーは、登録情報について正確かつ最新の内容を登録するものとし、虚偽の情報を登録してはなりません。

第3条（アカウント管理）

ユーザーは、自己の責任において、IDおよびパスワードを適切に管理するものとします。
IDまたはパスワードの管理不十分、使用上の過誤または第三者による不正使用によって生じた損害について、当方は責任を負いません。

第4条（禁止事項）

法令または公序良俗に違反する行為
犯罪行為または犯罪に関連する行為
本サービスの運営を妨害し、または妨害するおそれのある行為
他のユーザーまたは第三者の情報を不正に取得、収集または利用する行為
不正アクセスまたはこれを試みる行為
本サービスを不正または営利目的で利用する行為
当方または第三者の知的財産権、プライバシー、肖像権、名誉その他の権利または利益を侵害する行為
その他、当方が不適切と判断する行為

第5条（本サービスの提供の停止または中断）

システムの保守、点検または更新を行う場合
地震、火災、停電その他の不可抗力により、本サービスの提供が困難となった場合
通信回線またはシステムの障害が発生した場合
その他、当方が停止または中断を必要と判断した場合

第6条（知的財産権）

本サービスに含まれる文章、画像、動画、プログラムその他一切のコンテンツに関する著作権、商標権その他の知的財産権は、当方または正当な権利を有する第三者に帰属します。
ユーザーは、法令で認められる場合を除き、当方の事前の承諾なく、これらを複製、転載、配布、改変その他の方法で利用してはなりません。

第7条（利用制限および登録抹消）

当方は、本規約または個別規定に違反した場合、本サービスの全部または一部の利用を制限し、または登録を抹消することができます。
当方は、登録情報に虚偽の内容があった場合、本サービスの全部または一部の利用を制限し、または登録を抹消することができます。
当方は、その他ユーザーとして不適当と判断した場合、本サービスの全部または一部の利用を制限し、または登録を抹消することができます。

第8条（免責事項）

当方は、本サービスについて、安全性、信頼性、正確性、完全性、最新性、有用性、特定目的への適合性その他一切の事項について保証するものではありません。
本サービスに掲載または表示される情報は、変更、更新または削除される場合があり、実際の内容と異なる場合があります。当方は、掲載または表示される情報の正確性、完全性、最新性、有用性等を保証するものではありません。
ユーザーは、本サービスに掲載または表示される情報を自己の責任において利用するものとします。
当方は、本サービスの利用または利用不能によってユーザーに生じた損害について、当方の故意または重過失による場合を除き、責任を負いません。
本サービスからリンクまたはバナー等により他のウェブサイトへ移動した場合、移動先サイトで提供される情報、サービス等について、当方は責任を負いません。

第9条（サービス内容の変更または終了）

当方は、ユーザーに事前に通知することなく、本サービスの全部または一部を変更、追加、停止または終了することができます。

第10条（利用規約の変更）

当方は、必要と判断した場合には、本規約を変更することができます。
本規約を変更する場合は、変更後の内容および適用開始日を、本サービス上または当方が適当と判断する方法により周知します。
変更後にユーザーが本サービスを利用した場合には、変更後の本規約に同意したものとみなします。

第11条（サブスクリプション）

本サービスには、自動更新されるサブスクリプション（プレミアムプラン等）が含まれる場合があります。
サブスクリプションの名称、期間および料金は、購入画面に表示されます。
料金は、Apple App StoreまたはGoogle Playを通じて課金されます。
サブスクリプションは、現在の契約期間終了時の24時間以上前までに解約されない限り、自動的に更新されます。
サブスクリプションの管理および解約は、Apple IDまたはGoogleアカウントの設定画面から行うことができます。

第12条（反社会的勢力の排除）

ユーザーは、自らが暴力団、暴力団員、暴力団関係企業その他これらに準ずる反社会的勢力に該当せず、また将来にわたっても該当しないこと、および反社会的勢力と一切の関係を有しないことを表明し、保証するものとします。

第13条（準拠法および管轄）

本規約の準拠法は、日本法とします。
本サービスに関してユーザーと当方との間で紛争が生じた場合には、当方の所在地を管轄する地方裁判所または簡易裁判所を第一審の専属的合意管轄裁判所とします。

第14条（言語）

本規約は日本語版を正文とします。本規約の日本語版と英語版との間に内容の相違または矛盾がある場合、日本語版の内容が優先されます。

These Terms of Service (hereinafter referred to as the "Terms") set forth the conditions for the use of the website, web applications, and smartphone applications (collectively referred to as the "Service") provided by us.

Please read these Terms carefully before using the Service. By using the Service, you agree to these Terms.

Article 1 (Application)

These Terms shall apply to all relationships between users and us regarding the use of the Service.
We may establish additional rules, guidelines, or other individual provisions regarding the Service (hereinafter referred to as "Individual Provisions").
Individual Provisions shall constitute a part of these Terms. If there is any conflict between these Terms and Individual Provisions, the Individual Provisions shall prevail.

Article 2 (User Registration)

Certain features of the Service may require user registration.
A user registration application shall be submitted through the method specified by us, and a usage agreement shall be established when we approve the application.
Users shall provide accurate and up-to-date information when registering and shall not register false information.

Article 3 (Account Management)

Users shall manage their IDs and passwords appropriately at their own responsibility.
We shall not be liable for any damage caused by insufficient management, misuse, or unauthorized use of IDs or passwords by third parties.

Article 4 (Prohibited Activities)

Activities that violate laws or public order and morals
Activities related to criminal acts
Activities that interfere with or may interfere with the operation of the Service
Unauthorized collection, acquisition, or use of information belonging to other users or third parties
Unauthorized access or attempts to gain unauthorized access
Unauthorized or commercial use of the Service
Activities that infringe upon intellectual property rights, privacy rights, portrait rights, reputation, or other rights or interests of us or third parties
Other activities that we deem inappropriate

Article 5 (Suspension or Interruption of the Service)

We may suspend or interrupt all or part of the Service without prior notice to users in the following cases:
When performing maintenance, inspection, or updates of systems
When service provision becomes difficult due to earthquakes, fires, power outages, or other force majeure events
When communication networks or system failures occur
When we determine that suspension or interruption is necessary for other reasons

Article 6 (Intellectual Property Rights)

Copyrights, trademark rights, and other intellectual property rights relating to text, images, videos, programs, and all other content included in the Service belong to us or legitimate rights holders.
Users may not reproduce, republish, distribute, modify, or otherwise use such content without our prior permission, except where permitted by law.

Article 7 (Restriction of Use and Account Deletion)

We may restrict access to all or part of the Service or delete user accounts without prior notice if a user:
Violates these Terms or Individual Provisions
Provides false registration information
Is otherwise deemed inappropriate for continued use of the Service by us

Article 8 (Disclaimer)

We do not guarantee the safety, reliability, accuracy, completeness, timeliness, usefulness, suitability for a particular purpose, or any other aspects of the Service.
Information displayed or provided through the Service may be changed, updated, or deleted and may differ from actual information. We do not guarantee the accuracy, completeness, timeliness, or usefulness of such information.
Users shall use information provided through the Service at their own responsibility.
We shall not be liable for any damages incurred by users arising from the use or inability to use the Service, except in cases caused by our intentional acts or gross negligence.
We shall not be responsible for information, services, or other content provided on external websites accessed through links or banners from the Service.

Article 9 (Changes to or Termination of the Service)

We may change, add, suspend, or terminate all or part of the Service without prior notice to users.

Article 10 (Changes to These Terms)

We may modify these Terms when we deem it necessary.
When modifying these Terms, we will notify users of the changes and effective date through the Service or by a method we deem appropriate.
Users who continue to use the Service after changes become effective shall be deemed to have agreed to the modified Terms.

Article 11 (Subscription Services)

The Service may include automatically renewing subscription services, such as premium plans.
The name, duration, and price of each subscription plan will be displayed on the purchase screen.
Subscription fees will be charged through Apple App Store or Google Play.
Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current subscription period.
Users can manage or cancel subscriptions through their Apple ID or Google account settings.

Article 12 (Exclusion of Anti-Social Forces)

Users represent and warrant that they are not members of organized crime groups or any other anti-social forces, and that they have no relationship with such groups or individuals.

Article 13 (Governing Law and Jurisdiction)

These Terms shall be governed by and construed in accordance with the laws of Japan.
Any disputes arising between users and us in connection with the Service shall be subject to the exclusive jurisdiction of the district court or summary court having jurisdiction over our location as the court of first instance.

Article 14 (Language)

The Japanese version of these Terms shall be the official version. In the event of any discrepancy or inconsistency between the Japanese version and the English version, the Japanese version shall prevail.
